Ashley Biden, the daughter of former President Joe Biden, has officially filed for divorce from her husband of over 13 years, Dr. Howard Krein. The filing, submitted to Philadelphia’s Court of Common Pleas, marks the end of a relationship that began after the couple was introduced by the late Beau Biden in 2010. Following the legal filing, Ashley Biden, 44, shared symbolic messages on Instagram, including Beyoncé’s anthem “Freedom” and quotes regarding “new beginnings” and the establishment of “new boundaries.” While the specific cause of the separation remains private due to Philadelphia court regulations, the split represents a significant personal shift for the former first family, especially given Joe Biden’s historically close involvement in his daughter’s 2012 wedding in Greenville, Delaware, where he personally managed the reception details.

 

Simultaneously, the Biden family faces intense political and legal pressure from Washington D.C. as House Oversight Committee Chairman James Comer intensifies an investigation into Joe Biden’s mental capacity. Comer has indicated that his committee’s findings could be used to challenge the validity of various pardons and executive orders issued during Biden’s final months in office. A central point of the investigation is the frequent use of an autopen to sign legal documents. The Kentucky Republican argues that if the president was not fully aware of the documents being processed in his name, those actions might lack legal standing. Comer even suggested that some staff members could face potential criminal charges if it is proven they bypassed the president’s direct authorization while he was in a state of cognitive decline.

 

The legal basis for these challenges rests on fundamental Constitutional interpretations and the procedural integrity of the Executive Branch. Former Harvard Law professor Alan Dershowitz has pointed out that the Constitution explicitly requires the president to “sign” bills, a mandate that an autopen may not legally satisfy. This investigation follows a period of intense public scrutiny regarding Joe Biden’s health, punctuated by Special Counsel Robert Hur’s 2025 report which described him as a “well-meaning, elderly man with a poor memory.” Hur noted that Biden struggled to recall significant life events, such as his tenure as Vice President. Although Biden recently defended his record to The New York Times, asserting he made “every decision” regarding clemency acts, aides have admitted he did not individually approve every name within categorical pardons. This discrepancy, combined with the fallout from his “disoriented” 2024 debate performance, has provided Republicans with the momentum to question the legitimacy of his final acts in office.
